The Acting Inspector General of Police (IG) Gilbert Masengeli has failed to honor a Court order over the alleged abduction of two Kitengela brothers and an activist who have been missing for two weeks.
Masengeli had been issued with a new ultimatum by High Court Judge Lawrence Mugambi to appear in person before the Court at 3pm over the disappearance of the two siblings and an activist in Kitengela two weeks ago.
The Acting IG had been ordered to appear before the judge in person to explain why three men abducted in Kitengela have not been released.
Jamil Longton, Aslam Longton, and activist Brian Njagi were taken by individuals in suits who claimed to be police officers from Nairobi but provided no reason for the arrests.
The new order came following a directive by the Judge on August 23 issued to the Directorate of Criminal Investigations (DCI) and Police on disclosing the whereabouts of the trio after they were allegedly abducted on August 19.
Following their arrest, the Law Society of Kenya led by President Faith Odhiambo filed a petition for the grant of a writ of habeas corpus for the production and release of the three.

Odhiambo said that the trio was reportedly arrested and held incommunicado, with their families having no information on where they are being held.

Justice Lawrence Mugambi allowed LSK’s application, and in turn directed DCI and police to immediately disclose their whereabouts and release them or arraign them in court, either alive or dead.
However, the trio has remained missing since the order, with their whereabouts still not known.

While issuing the order, Judge Mugambi had said that the acting IG should appear in person to explain why the orders of the court were not being complied with. Masengeli had failed to appear on Monday morning.
However, the Attorney General, through state counsel Wanjiku Mwangi, urged the court to allow Masengeli to send a representative.
She claimed that her client also needed to establish from Kitengela Police Station whether the three had been arrested or not. She requested for three days.
Abduction
According to friends, family members, and boda boda riders in Kitengela, the trio was abducted shortly after addressing the media in Kamukunji police station Nairobi, to protest Wanjigi’s arrest.
“We request the president to keep his promise during campaigns that no one will be abducted or assassinated under his rule when elected,” said Abdulrazak Longton, brother to Jamil and Aslam.
A police report at the Kitengela Police Station indicated that Njagi was abducted while riding in a matatu, while Aslam and Jamil were taken from their car, which was left at the roadside.
“They were last seen being driven away in a white Subaru, license plate KDQ, to an unknown destination with all their phones going silent immediately after.
“We have not heard from them since Monday. The people who took them were in suits and ties and identified themselves as police officers. The boda boda riders saw them, but they refused to explain the reason for the arrests,” Abdulrazak said.
The families of the missing men’s plea for justice and answers continues as the days pass without any news on their loved ones despite the order by the High Court to Police and DCI on disclosing their whereabouts.
