Drama unfolded at the Milimani Law Courts on Wednesday, June 4 during the high-profile murder case involving the assassination of the late Kasipul Member of Parliament Charles Ong’ondo Were, when a suspect allegedly threatened to kill a State Prosecutor.
The suspect, Ebel Ochieng’ Kalo—who serves on the Lake Basin Development Authority (LBDA) board, allegedly threatened to kill a State Prosecutor while appearing before Justice Diana Kavedza.
According to the prosecution, Kalo directed his threat at Allan Mulama, an officer from the Office of the Director of Public Prosecutions (ODPP), causing the prosecutor to abruptly leave the courtroom.
“One of the accused persons, Ebel Ochieng, has threatened to kill the ODPP officer, Allan Mulama, forcing the state counsel to excuse himself from court,” the prosecution informed the judge.
Suspects threatens to kill State Prosecutor
This shocking turn of events left Justice Kavedza and everyone present in disbelief, as Kalo reportedly told the prosecutor he would kill him for opposing his bond release. Justice Kavedza promptly ordered enhanced security in court.
“I take note that the accused person has threatened to kill the prosecutor. The mere utterance of the words ‘huyu tutamuua’—the question is, what about the witnesses? On these grounds, the three are denied bond/bail. The first accused is to be escorted to Mathari Hospital for assessment,” she remarked in her ruling.
Justice Kavedza also ordered that all three accused persons remain in custody at Nairobi Remand Prison, with the third accused held in isolation pending the outcome of a mental evaluation. The case will be mentioned again on June 17 for further proceedings.

“This is deeply troubling. We intend to pursue this matter conclusively with the police. The court’s intervention is urgently needed,” the prosecution added.
Meanwhile, the High Court has directed that two other suspects in the murder case—Isaack Kuria and Allan Omondi Ogolla—undergo mental assessment before they face formal murder charges. Justice Margaret Muigai, presiding over a separate virtual session, issued the directive.
The judge further ordered that Kuria and Ogolla receive legal representation and be held at Kamiti Maximum Security Prison.

They will be detained separately as investigators pursue additional prosecutorial avenues, including potential plea deals.
The new developments come after Businessman Phillip Aroko, another suspect in the murder, was released on a cash bail of Ksh300,000 on May 27 issued earlier by the Jomo Kenyatta International Airport (JKIA) court.

This is after the court was told that the investigators in the case have pieced together required evidence, including Aroko writing his statement.
The state asked the court to release the businessman under similar conditions issued earlier by the JKIA court.
“With the 7 days you provided to the prosecution, we have been able to cover areas, the days have been utilised sufficiently in custody,” the court was told.
Aroko, representing himself, told the court that he will abide by the directions issued, including availing his passport in Kibera Court.
The late MP Charles Were was fatally shot on April 30, 2025, during rush hour at the City Mortuary roundabout on Ngong Road in Nairobi.
Police reports indicate that a gunman on a motorcycle fired at the lawmaker at close range before speeding off with the rider.
