Kenyans planning to visit the United States for tourism or business may soon face stricter visa requirements after Washington introduced a permanent Visa Bond Program.
According to the Department of State, the new visa rules and bond requirement will take effect on August 3.
The new program, according to the Department of State, will replace a one-year pilot program launched in August 2025.
However, the U.S. Department emphasized that the new set of rules applies to some applicants seeking B-1 business visas and B-2 tourist visas in select countries.
Under the program, U.S. consular officers may require applicants from designated countries to post a refundable bond of about KSh1.3 million, KSh1.9 million orKSh2.6 million, depending on the applicant’s circumstances.
“Consular officers may require covered nonimmigrant visa applicants to post a bond of up to $20,000 as a condition of visa issuance, as determined by the consular officers,” the Department of State directed.
U.S. authorities argued that the measure is intended to reduce visa overstays and encourage compliance with immigration laws.

Visa Bond Program
The bond will function as a financial guarantee that a visitor will follow the conditions of their visa and observe the authorized stay limit according to the authority.
Unlike standard visa fees, the bond is refundable. Under the new visa regulations, applicants who comply with all immigration requirements and depart the United States on time will be refunded.
However, the bond requirement will not apply automatically to every visa applicant, with consular officers determining whether a bond is necessary during the visa application process.
Applicants required to pay a bond must complete the regular visa procedures as prescribed at a U.S. embassy or consulate.
In addition, if a bond is deemed necessary, visa issuance will be delayed until the payment is made and confirmed.
Country Selection
According to the U.S. Department of State, countries subject to the visa bond requirement will be identified based on different factors.
Among the factors to determine the country selection are visa overstay rates, levels of cooperation in sharing information with U.S. authorities, the effectiveness of identity verification systems, criminal record management procedures, and the security of travel and civil documents.
Officials have further indicated that the list of affected countries may be updated from time to time as conditions change.
The State Department is expected to announce the countries covered under the permanent program separately.
Conditions for Visa Bond Refund
Travelers who receive visas under the program will be eligible for a refund if they observe all visa conditions.
Among the set conditions to guarantee a refund, the traveler must have traveled to the United States legally.
Further, the applicants must comply with the terms of the visa and leave before the authorized period of stay ends.
Applicants who lawfully seek an extension of stay or a change of immigration status may also remain eligible for a refund provided they continue to comply with U.S. immigration rules.
However, individuals who violate visa conditions, overstay their permitted stay, or fail to meet immigration requirements risk losing the bond.

Why the U.S. Made the Program Permanent
According to U.S. authorities, the decision to make the Visa Bond Program permanent follows the results of the 2025 pilot initiative.
The State Department explained that the data collected during the pilot suggested that visa bonds were effective in encouraging compliance among visitors and reducing immigration violations.
Officials further argued that the system helps strengthen the integrity of the U.S. immigration process while lowering the costs associated with investigating and removing people who overstay their visas.
The permanent rule also increases the maximum bond amount from $15,000 under the pilot program to $20,000 and removes the previous $5,000 option.
