Former Cabinet Secretary Raphael Tuju is facing eviction from his multi-billion-shilling property in Karen, Nairobi, amid a long-running legal dispute over billions of shillings in debt.
Speaking to the press at the disputed Dari Business Park on Tuesday, Tuju vowed to remain in the premises, declaring that auctioneers would have to “kill him first” before evicting him.
“They will have to kill me first and organise a big burial for me in Rarieda before they take this property,” Tuju, who was speaking after a scuffle between him and a group of people who tried to evict him, said.
In his remarks, Tuju argued that the court denied him an opportunity to appeal, even though the Constitution grants him that right.
“According to the constitution, I have a right to appeal, but the lady justice insisted that I don’t have that right unless she gives me the leave to appeal, which is a different interpretation of the constitution as far as I’m concerned because the Constitution 2010 gives me the right to appeal,” said Raphael Tuju.
Raphael Tuju Faces Eviction from Multi-Billion Shilling Karen Property
The former cabinet Minister accused auctioneers of invading his property and claiming to have purchased it, despite the ownership dispute still being active in court.
Raphael Tuju further said that attempts to evict him from the property were part of a wider conspiracy aimed at pressuring and intimidating him amid the ongoing legal battle over the property.

Additionally, he linked the unfolding dispute to previous events at the property, during which several individuals were arrested.
According to Raphael Tuju, the people arrested included a former judge and a lawyer who had allegedly gone to his residence, claiming to act on behalf of a judge.
He claimed the trio had approached him seeking money in exchange for influencing the outcome of matters related to the property dispute.
“People are arrested at my place because they were insisting that I must give them money for this judge to allow any appeal or any stay of execution.”
Despite the mounting legal pressure, Tuju maintains that he will remain at the property, insisting that any forceful eviction would amount to harassment while the case is still before the courts.
Court Orders Eviction of Tuju’s Property in Karen
On March 9, 2026, the High Court of Kenya cleared the way for the auction of properties linked to former Cabinet Secretary Raphael Tuju after dismissing a case seeking to block the forced sale in a long-running multi-billion-shilling loan dispute.
In a ruling delivered by Justice Josephine Wayua Mong’are, an application by Dari Limited and Tuju seeking to stop the auction of two Karen properties was struck out.

The court also lifted earlier interim orders that had temporarily stopped the auction, allowing the lender and appointed auctioneers to proceed with the recovery process.
The properties had been used as security for a $9.3 million loan facility advanced to Dari Limited in 2015 by the East African Development Bank (EADB) to finance property developments in Nairobi’s Karen suburb.
After the loan fell into default, the lender initiated recovery proceedings, with the debt growing through accumulated interest and legal costs.
The bank is now seeking to recover more than KSh4.5 billion through the sale of the charged properties.
To facilitate the sale, the lender had appointed Knight Frank as valuers and Garam Investment Auctioneers to handle the auction process.
