United States President Donald Trump has announced that anyone caught burning the American flag “will be immediately arrested” and face a one-year prison sentence in a message to the U.S. Immigration and Customs Enforcement (ICE), Customs and Border Protection, and the military.
The US President referenced his August 25, 2025, executive order on flag desecration. “To ICE, Border Patrol, Law Enforcement, and all U.S. Military: As per my August 25, 2025, Executive Order, please be advised that, from this point forward, anybody burning the American Flag will be subject to one year in prison,” Trump wrote on Truth Social Friday, October 3, evening. “You will be immediately arrested. Thank you for your attention to this matter!”
Although Trump’s announcement suggests strict criminal penalties, the executive order itself does not create new laws or penalties. Instead, it directs the Department of Justice to enforce existing federal, state, and local laws related to flag desecration “to the maximum extent permitted by the Constitution.”

The executive order emphasizes the symbolic importance of the flag, calling it “the most sacred and cherished symbol of the United States of America, and of American freedom, identity, and strength.” It states that burning the flag is “a statement of contempt, hostility, and violence against our Nation” that may “incite violence and riot.”
“The American Flag is a special symbol in our national life that should unite and represent all Americans of every background and walk of life. Desecrating it is uniquely offensive and provocative. It is a statement of contempt, hostility, and violence against our Nation — the clearest possible expression of opposition to the political union that preserves our rights, liberty, and security,” the executive order reads.
“Burning this representation of America may incite violence and riot. American Flag burning is also used by groups of foreign nationals as a calculated act to intimidate and threaten violence against Americans because of their nationality and place of birth.”

Despite referencing constitutional limits, Trump’s announcement signals a more aggressive enforcement stance—one that may face legal challenges. The Supreme Court has twice ruled that flag burning is a form of protected speech under the First Amendment, most notably in Texas v. Johnson (1989) and United States v. Eichman (1990).

Still, the executive order argues that those rulings do not cover acts that incite imminent lawless action or amount to “fighting words.” It directs the Attorney General to “vigorously prosecute” individuals involved in such acts and encourages litigation to “clarify the scope of the First Amendment exceptions” related to flag desecration.
The order also outlines a range of possible legal actions under existing laws, including enforcement of statutes relating to hate crimes, civil rights violations, property damage, and even immigration consequences for foreign nationals who engage in flag desecration. In such cases, agencies are instructed to deny or revoke visas, naturalization, and other immigration benefits “pursuant to Federal law.”

White House spokeswoman Abigail Jackson, while speaking to Fox News Digital, defended the move, saying, “President Trump will not allow the American Flag, a special symbol of our country’s greatness, to be used as a tool to incite violence and riots that jeopardize the safety of everyday Americans.”
“President Trump will always protect the First Amendment, while simultaneously implementing commonsense, tough-on-crime policies to prevent violence and chaos,” Jackson added.
The executive order includes standard legal disclaimers about severability and enforcement, clarifying that it does not create any private right of legal action and will be implemented “consistent with applicable law and subject to the availability of appropriations.”
