ANC candidate for the Fafi parliamentary seat has been disqualified from contesting.
The High Court disqualified Mohamed Subey Gedi for holding three citizenships.
Lady Justice Abida Aroni declared Gedi’s clearance by the Independent Electoral and Boundaries Commission as unconstitutional, null and void
Gedi is a citizen of three countries including America, Kenya, and Somalia.
Under Article 78(1) of the Constitution, a person is not eligible for election to a state office unless the person is a citizen of Kenya.
“I hereby hold that the first respondent (Gedi) is unqualified to run for the position of Member of Parliament for Fafi Constituency,” Justice Aroni ruled
She ordered the IEBC to withdraw the clearance certificate issued to Gedi immediately.
ANC cleared Gedi to face off with Salah Yakub of UDA, Abdikain Osman of Jubilee and Mohamed Diis Shafat of KANU in the Fafi constituency race.
