Makueni Senator Dan Maanzo has filed a censure motion against President William Ruto.
In his motion, Maanzo argues that the Head of State has reduced the allocation to counties and delayed financing to devolved units causing untold suffering to Kenyans who are sick by failing to devolve Health and Agriculture fully as required by article four (4) of the constitution.
He also adds that Ruto has failed to protect Kenyans against police brutality and killings that has been recently witnessed in the country.
The senator also in his motion mentioned that President Ruto has marginalized section of Kenyans created and continues to heighten tension among different segments of Kenyans due to lack of proper public participation on SHIF, SHA and University education fees module.
Other segments include Affordable Housing, Airport Leasing among others in contradiction of Articles 10(2), 119(1), 174(c), 232 (1) which demean the high office of the President of the Republic of Kenya.
“Now therefore, the Senate pursuant to standing order 101(1) expresses displeasure and disappointment with the conduct of Dr William Samoei Ruto, CGH. as the President of Kenya and censures him,” read part of the motion.
Senator Dan Maanzo Censure Motion Against Ruto
Here is the full motion:
That aware that Article 260 of the Constitution of Kenya categorizes the President as a State Officer whose conduct and behavior shall abide by provisions of Articles, 73,75,77 of the Constitution of Kenya and the general leadership and integrity’s code for state officers contained in the Leadership and Integrity Act CAP 185C of the Laws of Kenya.
Further aware that pursuant to Article 131(1)(e) (2) (c) (d) the President is the symbol of National unity and shall promote and enhance the unity of the Nation; shall promote respect for the diversity of the people and communities of Kenya.
Concerned that Article 25(a) (c) provides for rights and fundamental freedoms which cannot be limited, the right to freedom from torture and cruel inhuman treatment or degrading treatment or punishment, right to fair trial bearing in mind the recent abductions, torture and disappearances of Kenyans.
Accusations Against Ruto
Concerned that Dr William Samoei Ruto, President of the Republic of the Republic of Kenya and Commander-in-Chief of the Kenya Defence Forces is the Head of State and Government under Article 131, and the Chairperson of the National Security Council have failed to protect Kenyans against police brutality and killings and have reduced the allocation to counties and delayed financing to devolved units causing untold suffering to Kenyans who are sick by failing to devolve Health and Agriculture fully as required by article four (4) of the constitution.
Further concerned that the said breach as of the constitution by Dr William Ruto, have marginalized section of Kenyans created and continues to heighten tension among different segments of Kenyans due to lack of proper public participation on SHIF, SHA, University education fees module, Affordable Housing, Airport Leasing among others in contradiction of Articles 10(2), 119(1), 174(c), 232 (1) which demean the high office of the President of the Republic of Kenya.
Maanzo on Why Both Ruto and Gachagua Must Be Impeached
Senator Dan Maanzo had earlier said Ruto and DP Rigathi Gachagua were elected together and if the DP’s impeachment motion materializes, they will table another to send Ruto home.
“If there is an impeachment motion against the Deputy President, then we will also have an impeachment motion against the President. They’re elected on one ticket,” Maanzo said.
“If there is anyone who has breached the constitution more it is the President, not his deputy… we will tie them together and run the impeachment motions concurrently at the National Assembly and the Senate. I dare them to bring the motion!”
The impeachment motion against Rigathi Gachagua shall be moved by Kibwezi West Member of Parliament (MP) Mutuse Mwengi.
The impeachment grounds include Gross violation of the Constitution or any other law pursuant to article 150 (1) (b) (1) of the constitution and Gross Misconduct (Bullying).
