He studied his undergraduate studies at the University of Nairobi in 1979, however, he attained his law degree from the University of Dar-es-Salam in 1983.

Later, in 1985 he moved to Harvard Law School where he graduated with a master’s degree for the second time.
In 1987, he graduated with a doctorate in law from Harvard University.
Career Background
He began his teaching career at the University of Dar-es-Salam where he taught international trade from 1983 to 1984.
He went on to teach at the State University of New York, Deusto Bilbao University in Spain, and the United Nations University for Peace in Costa Rica.
Makau also taught University of Puerto Rico School of Law San Juan, the University of Iowa College of Law, and Harvard Law School.
He is experienced as an International Human Rights lawyer for Law Group Ferguson Fellow in 1985.
Further, from 1989 to 1991 he was a legal advisor for Litvin, Blumberg, Matusow, and Young Philadelphia, associate at white and Case New York, and director of the African project for the Lawyers Committee in New York.
Moreover, he is currently the SUNY Distinguished Professor and Margret W. Wong professor at Buffalo Law School.
In 2016, he made an unsuccessful attempt for the office of Chief Justice at the Supreme Court of Kenya.

He is a member of the Council on Foreign Relations and chairman of the Kenya Human Rights Commission.
