Rael Mayaka, the grandmother of Baby Sagini was on Friday, February 2, spotted joyfully singing outside the courtroom moments after the Court set her free. According to the Court, the granny was found not guilty.
“God helps me. I’m now going to my home joyfully. It’s me and me alone,” she stated.
The Court of Appeal released the 80-year-old woman who was imprisoned for allegedly gouging out the eyes of her grandson, Baby Sagini.
The court overturned a ruling that had handed the granny a five-year jail term, arguing that her case was weak and that the evidence produced before the court was not satisfying.
Prior to the ruling, the judge said that the evidence put out by the prosecution was insufficient to sustain the case.
Justice Kiarie said that there was insufficient evidence to establish the accused’s guilt and that the prosecution had not proven its case beyond a reasonable doubt.

Rael was imprisoned together with two others who did not challenge the judgement.
The grandmother, the cousin, and the aunt of the infant Sagini were charged on July 25, 2023, with grave harm to the victim in violation of section 234 of the penal code, which carries a life sentence according to the Constitution of Kenya 2010.
Twelve witnesses testified that the three accused were guilty of committing the offense when they appeared before Magistrate Christine Ogweno.

“After weighing the evidence presented by both the prosecution and the defense, I am convinced that the prosecution has proven, beyond a reasonable doubt, the charges against each of the accused persons,” she stated.
“There are aggravating circumstances arising from this matter; the minor is not only blind, but he is missing both of his eyes.”
