Governor Kawira Mwangaza can now breathe a sigh of relief after Meru High Court suspended an impeachment motion against her.
Justice Wamae Cherere in a ruling on Wednesday, November 30 stated that the Meru County Assembly did not follow a proper procedure in initiating the motion.
Moreover, governor Mwangaza moved to court last week seeking orders to bar the County Assembly from debating her impeachment motion.
According to the Meru governor, allowing the motion to proceed would be unfair to her because it proved to have a predetermined outcome as 68 of the 69 MCAs had approved the motion. She also argued that the county assembly would not act as an impartial arbitrator.
She says the debate would violate her rights to have the dispute determined before an independent and impartial body.

In addition, the governor through her lawyer Elias Mutuma argued that the publication of the impeachment motion was called and signed by a stranger in the assembly acting as the clerk.

Furthermore, she stated that the position of the assembly clerk fell vacant on November 19 and the process of finding a replacement had not started.
Kawira Mwangaza also asked the court to suspend letters issued by Mr Launi inviting her to respond and appear before the assembly for the impeachment motion.
Nonetheless, the motion to impeach Mwangaza was tabled by Abogeta West MCA Dennis Kiogora, who also doubles as the Minority Chief Whip on November 21.
