Daniel Onyango, a Kenyan tailor, has found himself before the high court after a client sued him for ruining a Herr Widman suit worth Ksh35,000.
Onyango is accused of burning the brand-new grey suit that had been taken for a few alterations by Gatheru Gathemia, the complainant in May 2021.
According to Gathemia, Onyango entered into an agreement with him after the incident and was supposed to pay him Ksh3,000 every month until he had paid off the whole amount.
He argued that the tailor ought to have known to take the suit to the laundry for washing and ironing.
However, when Gathemia filed his case first before the small claims court, magistrate Carol Ndumia, dismissed it forcing him to escalate the case to the High Court.
Tailor Responds to Claim
In response to the claims, Onyango said that he was forced to enter into the agreement. Also, he said that the matter had caused him too much anxiety adding that he was unable to sleep.
Additionally, Onyango lamented that he was not able to run his tailoring business effectively because of the emotional anguish.
“Appellant’s suit was dismissed on merit and on the basis that he forced me and or subjected me under duress to sign the contract and which duress led to the said contract.
“The appellant has subjected me to untold emotional anguish. I have not been able to concentrate on my small-time tailoring work in the midst of the current economic turmoil,” Onyango said.
