The Kenya Magistrates and Judges Association (KMJA) has criticized former Law Society of Kenya (LSK) President Nelson Havi and his counterpart Ahmednasir Abdullahi over what they described as systemic attacks on the Judiciary.
In a statement issued during a press conference on Friday, December 13, the Association, through its President, Justice Stephen Radido, threatened to sue the duo and other legal practitioners who have been accused of making unwarranted claims against the Judiciary.
Furthermore, Justice Radido stated that the attacks on the Judiciary were self-serving.
“The Association has keenly analyzed these online attacks. Their systemic nature, execution, and sustained onslaught demonstrate an unorthodox and unconstitutional attempt to intimidate the Judiciary, its leadership, judges, and magistrates to advance a self-serving agenda,” he said.
Ahmednasir and Havi were accused of unfairly criticizing the judiciary
According to KMJA, the attacks against the Judiciary undermine its integrity and authority.
“It is, therefore, quite disheartening and a show of bad faith for members of the Law Society of Kenya to renege on raising concerns through the formal avenues in place.”
They have abandoned the well-established mechanisms and opted to employ eccentric tactics such as cyberbullying and other forms of online attacks for ulterior motives,” Justice Radido added.
In response to the KMJA statement, Havi issued a rebuttal, saying, “The lame lamentations by the KMJA contained in a statement released today must be dismissed with the contempt they deserve.”

He further stated that he had submitted a detailed affidavit to the Judicial Service Commission (JSC), requesting it to recommend to the President of the Republic of Kenya the formation of a tribunal to remove Justice Alfred Mabeya from his position as a Judge of the High Court of Kenya.
Lawyers Ahmednasir and Havi have accused some unnamed judicial officers of engaging in corruption.

Ahmednasir, in particular, has on numerous occasions used the term “Jurispesa” — a term implying that certain judicial officials accept bribes to influence court cases in favour of specific clients.

The KMJA statement comes days after Chief Justice Martha Koome revealed that she is a victim of cyberbullying and asserted that she will not resign despite calls for her to step down.

“I’m a victim of cyberbullying. It’s a form of technologically facilitated gender-based violence.
I know the intentions behind it — it’s a business model. I don’t know what they aim to achieve, perhaps to scare me, disrupt me, defame me, or force me out of office. But they can try something else,” she said.
