A federal judge has temporarily blocked President Donald Trump’s plan to federalize and deploy National Guard troops to Oregon.
In a late-night order on Sunday, US District Judge Karin Immergut granted a temporary restraining order halting the federalization, relocation, or deployment of any Guard members to Oregon from any state while the dispute is played out in court.
The move comes after state leaders and local officials challenged Trump’s decision to send 300 California National Guard members to Portland following an earlier court ruling blocking the deployment of Oregon’s own Guard troops.
California Governor Gavin Newsom accused Trump of abusing his authority on the deployment of National Guard Troops.
“We just won in court, again. A federal judge blocked Donald Trump’s unlawful attempt to deploy 300 of our National Guard troops to Portland,” his office wrote on X.
“The court granted our request for a temporary restraining order, halting any federalization, relocation, or deployment of any guard members to oregon from any state. Trump’s abuse of power won’t stand.”
Court’s Decision on National Guard Troops
Judge Immergut, herself appointed by Trump, wrote that the Trump administration had failed to show that conditions in Portland justified such a forceful federal intervention.

“The President’s determination was simply untethered from the facts,” she wrote in an earlier ruling.
During Sunday’s hearing, the judge pushed back on attempts by the Justice Department to argue that the earlier order applied only to Oregon’s troops.
She emphasized that her concern was about the conditions on the ground in Oregon, which had remained unchanged.
She said the use of the military to quell unrest without the consent of the state of Oregon risked the sovereignty of that state and others, adding that it also inflamed tensions in the city and led to increased protests.
Governors Against Trump’s Move
Governors in California and Illinois have already criticized the deployment plans, calling the move unconstitutional and politically motivated.

Newsom has pledged to sue, while Illinois Governor J.B. Pritzker also denounced the federalization bid.
The court’s decision will remain in effect through at least October 19 as Oregon and California continue their broader legal challenge to Trump’s attempted troop deployment.
Oregon Governor Tina Kotek applauded the court’s decision and said she hopes Trump will respect the order and halt the deployment.
“There is no insurrection in Portland, no threat to national security,” she said in a statement. “The only threat we face is to our Democracy and that threat is being led by President Trump.”
