The National Assembly has nominated Members of Parliament (MPs) to represent them at the Senate during the impeachment motion tabled against Deputy President (DP) Rigathi Gachagua.

The four MPs will represent the Assembly along with the mover of the motion, Kibwezi West MP Mwengi Mutuse.

According to State House Standing Orders, the Special Committee may hear representations from the member who moved the motion in the National Assembly and other members of the National Assembly.

The House has selected a bipartisan team to join Mutuse during the impeachment proceedings in the Senate, all of whom are lawyers.

From the Kenya Kwanza Coalition, the House picked Tharaka MP Goerge Murugara and his Kanduyi counterpart John Makali.

Murugara chairs the Justice and Legal Affairs Committee, while Kanduyi is a member.

From the Minority side, the National Assembly selected Rarieda MP Otiende Amollo and Homa Bay Town MP Peter Kaluma, both from the ODM party.

Otiende is also a member of the Justice and Legal Affairs Committee.

Senate Gachagua Impeachment Debate Schedule

Gachagua will face the full Senate as he fights attempts to remove him from office through impeachment.

Speaker Amason Kingi ruled that the trial for the removal of the Deputy President will occur during the plenary after Deputy Minority Edwin Sifuna refused to second the motion to establish an 11-member special committee.

As a result, the Speaker set Wednesday, October 16, and Thursday, October 17, as the trial dates.

The National Assembly adopted the motion for the impeachment of the Deputy President on October 8, 2024, citing 11 grounds.

National Grounds for Impeaching the DP

This includes gross violations of the Constitution, which involve undermining the President, the Cabinet, and the effective discharge of the national government’s executive mandate.

Gachagua also faces accusations of undermining devolution and violating Article 160 (1) of the Constitution regarding the institutional and decisional independence of judges.

The National Assembly alleges serious reasons to believe that the Deputy President has committed crimes under the National Cohesion and Integration Act, gross economic crimes under the Anti-Corruption and Economic Crimes Act, and violations of the Proceeds of Crime and Anti-Money Laundering Act.

The allegations also claim that Gachagua has committed offenses by continuously misleading the public through false, malicious, divisive, and inciteful remarks that violate the Penal Code and the Leadership and Integrity Act.

Additionally, he faces accusations of gross misconduct incompatible with the high calling and dignified status of the Office of the Deputy President, as well as membership in the Cabinet and the National Security Council.

He is accused of publicly attacking and undermining the work of the National Security Intelligence Service and its officers, openly undermining the President, who is the Head of State and Government, and persistently bullying state and public officers.
