The High Court has temporarily blocked Equity Bank Kenya from taking control of Swafi Foods Limited, following the bank’s appointment of joint administrators last month under the Insolvency Act of 2015.
In a ruling delivered on September 4, the High Court ordered a stay of execution, halting the takeover and restraining the appointed administrators from managing or interfering in the affairs of the food processing company.
“The Judge ordered a temporary restraining order restraining the Administrators of Swafi Foods Limited from taking over the management of Swafi Foods / Swafi Foods Limited. According to all affairs of the company are accordingly managed by the CEO,” the court notice read.
The court decision follows Equity Bank’s move on August 25 to place Swafi Foods under administration.
Equity Bank Take Over
The bank appointed Kamal Anantroy Bhatt and Jai Kamal Bhatt of Anant Bhatt LLP as joint administrators, effective August 18, granting them full authority over the company’s assets and operations.

Under the administration arrangement, all powers previously held by Swafi Foods’ directors were to be transferred to the administrators, who would oversee the firm’s restructuring and address creditor claims.
As per the terms of the administration, creditors were required to submit written claims with supporting documents to Anant Bhatt LLP by September 18.
The administrators were not to be held personally liable for the company’s obligations during the process.
In the court order, all administrative actions have been paused, and management of Swafi Foods remains in the hands of the company’s directors until further notice.
In a public notice, the company clarified that any questions or requests for clarification should now be directed to Swafi Foods’ management via their Mombasa office.
