The Court of Appeal has ordered former Nairobi County Chief Finance Officer Jimmy Mutuku Kiamba and his wife to surrender Ksh114 million and seven prime properties to government.
The two were being investigated by the Ethics and Anti-Corruption Commission (EACC) for acquiring multimillion assets through corruption.
According to a statement by EACC on Tuesday, February 13, the properties were acquired as a result of proceeds from the Nairobi County Government.
“The court of appeal dismissed two appeals filed by former Nairobi County Chief Finance Officer Jimmy Mutuku Kiamba and his wife in a recovery case where EACC wanted the couple’s corruptly acquired multimillion assets forfeited to the Government of Kenya.
“The assets are believed to be proceeds of corruption at the Nairobi County Government,” the statement read in part.

Justices Dr. Laibuta, Ali-Aroni and J. Mativo ordered the couple to pay Ksh 113,893,743 to the government as it was unexplained cash held in multiple bank accounts.

Also, they were ordered pay the current market value of 7 prime properties acquired through corruption.
The property included L.R. NO. 209/12742, Skyrock Apartments, Block B, Unit 11 L.R. No.330/317, Apartment No. B1 Block B, Pritt Lane Court 2 on L.R. No. 2/699, Lease No.127012/1.
Other property included Apartment No. B5 Block B, Pritt Lane, Court 3 on L.R. No. 330/1310, Lease No. I.R.136088/1, Apartment No. B8 Block A, Pritt Lane – Court 3 on L.R. No. 330/1310 Lease No. 136089/1, L.R. No. 7785/605 (original No. 7785/10/430) I.R. 56556; and L.R. No. 7785/818 (Original 7785/10/55).
“Kiamba had moved to the Court of Appeal after the High Court (Hon. Lady Justice Ong’udi) concurred with EACC that he was in possession of unexplained assets worth Kes. 317 million.
“Investigations established huge disparities between his assets and his known legitimate sources of income which he was unable to explain prompting EACC to file the forfeiture case,” the statement added.

Ksh643 Million Belonging to former Nairobi City County Employee
In a separate incident on February 8, the High Court declined to unfreeze Ksh643 million worth of assets belonging to a former Nairobi City County junior employee and a popular club owner Wilson Nahashon Kanani.
The assets listed by the Ethics Commision included landed properties, high-end vehicles and Ksh48 million held in various bank accounts.
Further, according to the EACC, Kanani was a co-director of a private company trading as 1824, a popular bar and nightclub along Langata Road, Nairobi.
