A political dispute has erupted in Virginia after ICE accused Democratic leaders of allowing the release of an undocumented immigrant charged with assaulting multiple students at Fairfax High School.
The controversial case in the U.S. state of Virginia ignited a heated debate over immigration enforcement, school safety, and local cooperation with federal authorities after the immigrant accused of sexually assaulting multiple high school students was released rather than transferred to federal immigration custody.
The suspect, identified as 18-year-old Israel Flores Ortiz, was arrested on March 7 and charged with nine counts of assault and battery following allegations that he groped a dozen female students inside Fairfax High School. Authorities say the incidents reportedly occurred in school hallways and may have been happening for months before students reported them.
According to Immigration and Customs Enforcement (ICE), Ortiz entered the United States illegally from El Salvador in 2024. Despite his arrest, he was not transferred to federal immigration custody after the Fairfax County Sheriff’s Office declined a request from the Department of Homeland Security (DHS) to detain him for immigration authorities.
Allegations Inside School Hallways
The case began drawing attention after multiple students accused Ortiz of inappropriate touching while at school. One parent told local media that the alleged behavior involved Ortiz approaching girls from behind and placing his hand between their legs.
Parents say the incidents created fear among students and raised serious concerns about safety within the school system. Many of them gathered outside a courthouse in Fairfax County this week, demanding stronger action from local authorities.
Several parents have also criticized how the school initially described the alleged incidents. In a letter sent to families on March 12, school officials reportedly referred to the accusations as “a student touching students’ buttocks,” wording that some parents argued downplayed the seriousness of the allegations.
“It was not just a butt grab,” one parent said. “It was groping of a private area, and it had been happening for several months.”
ICE Requests Detainer
Following Ortiz’s arrest, federal immigration officials asked the Fairfax County Sheriff’s Department to honor an immigration detainer. Such requests typically ask local law enforcement agencies to hold undocumented immigrants for up to 48 hours after their release date so federal agents can assume custody.
However, the sheriff’s department declined the request.
Federal immigration officials criticized the decision, arguing that policies limiting cooperation between local authorities and ICE could allow potentially dangerous individuals to remain in the community.

An ICE spokesperson said sanctuary-style policies adopted by some local and state leaders are preventing federal agents from removing undocumented immigrants accused of crimes.
The spokesperson also called on Fairfax County authorities to reconsider their decision and allow federal officials to take custody of Ortiz.
Governor Under Political Pressure
The situation has drawn criticism toward Virginia Governor Abigail Spanberger, whose administration introduced policies earlier this year aimed at reducing cooperation between state agencies and federal immigration enforcement.
Those policies contributed to the decision not to transfer Ortiz to immigration custody. Spanberger had recently posted on social media about her commitment to strengthening Virginia’s public school system and supporting young people in the state.
The post was quickly met with criticism from some residents who pointed to the Fairfax case as evidence that school safety should be a higher priority.
Online responses included complaints from parents who said their children did not feel safe following the allegations at the school.
School District Responds
Fairfax County Public Schools acknowledged the situation but said it could not comment in detail because of privacy laws and the ongoing legal process.
In a written statement, the district emphasized that student safety remains its highest priority and that any reported incidents are fully investigated.
School officials also said they continue to cooperate with law enforcement when incidents affecting student safety occur.
