Prime Cabinet Secretary and Cabinet Secretary for Foreign and Diaspora Affairs Musalia Mudavadi has responded to former Deputy President Rigathi Gachagua’s call for the International Criminal Court (ICC) to monitor Kenya due to the reemergence of suspected organized criminal gangs.
Speaking on January 19, Mudavadi said the government cannot stop Kenyans from writing to the ICC.
Mudavadi said a section of Kenyans might be emotional about the issues facing the county and they have a right to inform the ICC.
“People may react emotionally. We cannot take away Kenyans’ rights to write to the ICC or to send messages to the ICC. It is their right and we cannot stop them,” Mudavadi said.
Mudavadi Gives Govt Position
However, he clarified that the government would prioritize the affairs and security of the country.
“What is important is for the government of Kenya to be focused and to manage the affairs and guaranteed security of all Kenyans. That we cannot do without blinking,” he added.
Gachagua Ask ICC to Intervene
Gachagua has accused the government of aiding former Mungiki leader Maina Njenga to cause chaos in Mt. Kenya.
Speaking on January 19, Gachagua and his allies called out Njenga to storm an event he was supposed to attend the previous day.
“The group killed our people and if you bring it up our people will hate you even more,” Gachagua said.

He directed his allies to assemble lawyers to write to the ICC to avoid any loss of lives.
Gachagua warned that the current abductions, killings of young Kenyans and reemergence of criminal gangs in certain regions highlight this troubling trend.
“The ICC should not wait until crimes against humanity have been committed. Get a team of lawyers to write to the ICC to invite them to come to Kenya and make sure that the activities of criminal gangs are not allowed to take place,” Gachagua said.

How Gangs Terrorized Mt. Kenya
Gachagua recounted how gangs brutally terrorized the people of the Mt. Kenya region in the past.
Additionally, he described how these gangs beheaded individuals, circumcised women, raped girls, and defiled children.
He assigned Mukurweini MP John Kaguchia the task of documenting Mungiki-related crimes from previous decades, especially from the 1990s, for submission to the ICC.
“You should document the atrocities that were previously committed by the same gangs because those were crimes against humanity and start engaging the International Criminal Court.”
