Ichung’wah Slapped with Demands Over Remarks in Ruto’s Presence

Kikuyu Member of Parliament (MP) and Leader of the Majority in the National Assembly Kimani Ichung’wah is staring at a legal battle after his scathing attack on Trans Nzoia Governor George Natembeya in the presence of President William Ruto. 

In a statement through Oringe Waswa and Opany Advocates dated January 6, 2025, his lawyers referred to Ichung’wah’s remarks during the burial service of the National Assembly Speaker Moses Wetangula’s mother, on January 3, 2025, in Kabuchai Constituency, Bungoma County.

“We act for the aforementioned client who has instructed us to write to you as hereunder;

That on Friday, 3rd January 2025 during the burial service of Speaker of the National Assembly Moses Wetangula’s mother in Kabuchai Constituency, Bungoma County with the Republic of Kenya, you falsely, maliciously, recklessly and with intent to injure our client’s reputation, uttered the undocumented words,” the statement read.

Natembeya threatens to sue Ichuung’wah over defamatory remarks

According to the letter, during the event,  Ichung’wah publicly accused Natembeya, who was formerly a Regional Commissioner, of being involved in abductions and murders during his tenure.

The specific remarks attributed to Ichung’wah were, “Wakati mliua watu mkaweka River Yala (when you killed people and dumped in River Yala), you were the Regional Commissioner in charge of Abductions and murdering Kenyans, wewe mwenyewe, shame on you, shame on you, shame on you, and I say again shame on you Governor, you cannot claim abductions when you were the key abductor and murderer of  Kenyans in the previous regime.”

Natembeya asserted that the remarks were made with the intent to defame him, portraying him as unethical, unprofessional, and responsible for heinous acts, specifically the killing of Kenyans and disposing of bodies in River Yala.

According to the Governor’s lawyers, the accusations are false and have severely damaged his reputation, credibility, integrity, and professional standing both locally and internationally.

Oringe Waswa and Opany Advocates argue that the remarks were made with full knowledge of their libelous nature or with reckless disregard for the truth.

They stressed that Natembeya’s role as a Regional Commissioner did not include any involvement in murders, thus deeming the accusations baseless and harmful.

Consequently, Natembeya  demanded a retraction and a public apology from Ichung’wah.

Through his lawyers, he indicated that the apology should be published in the next issue of Nation, Standard, and Star newspapers, in a manner similar to the original statement.

Furthermore, Natembeya gave Ichung’wah three days to comply with this demand, failure to which legal proceedings will be initiated against him to recover all consequential costs and expenses.

Ichungwah’s attacked Natembeya came after the Governor condemned the current wave of abductions in the country where he publicly urged President William Ruto to stop the abductions.
