Full Breakdown of How Govt Will Share KSh 2 Billion Among Protest Victims

The Kenya National Commission on Human Rights (KNCHR) has proposed a compensation framework for the victims of protests.

In 2026, the commission reported documenting 1,815 claims and received a further 1,022 from the Independent Policing Oversight Authority (IPOA) regarding protest victims.

According to the commission, protest victims were recorded across several categories of violation, including sexual violence, enforced disappearance, and right to life.

“The Commission documented 1,815 claims and received 1,022 from the Independent Policing Oversight Authority. Through this process, the Commission has so far verified and obtained consent from a total of 1101 victims across six categories of violations: the right to life (245 victims); sexual violence (75 victims), freedom from torture (135 victims), freedom and security of the person (473 victims); right to property (138 victims) and enforced disappearance (35 victims),” KNCHR report 2026 read.

KNCHR Repatriation Report 2026 outlines a minimum of KSh 50,000 and a maximum of KSh 2.5 million, depending on the nature of the violations suffered by the victims.

KNCHR Compensation Breakdown

The commission has outlined that victims of the right to life violation, which include those who suffered from fatal shooting, death in custody, and during custody, will receive a minimum of KSh 2.5 million.

In addition, the 245 protest victims who suffered a violation of the right to life will also receive medical expenses.

35 protest victims who suffered from enforced disappearances are set to receive a minimum of KSh 1.5 million.

Among the 473 victims who were injured during the protests, victims who sustained severe injury will receive a minimum of KSh 1 million. In contrast, those with moderate physical injuries will receive KSh 500,000 and medical expenses.

 Minor physical injury victims will be compensated with a minimum of KSh 50,000, with medical expenses.

Protest victims who were arrested and detained will receive KSh 50,000, with no coverage for medical expenses.

Tortured victims will be awarded a minimum of KSh 2 million in addition to medical expenses.

Among the sexual violence victims, 32 who suffered from aggravated sexual violence are set to receive a minimum of KSh 2 million and medical expenses.

43 of the sexual violence victims who suffered from rape, defilement, and sexual assault, according to KNCHR, will be compensated with KSh 750,000 and medical expenses.

138 business owners whose property was destroyed will be compensated with a minimum of KSh 100,000.

Protest Victims and Restitution

The commission has recommended that in compensating the victims, the protest victims should be granted the social health benefits to support continued medical care and psychosocial support.

In addition, the commission proposes that the victims’ education and livelihood support should be considered.

Further, there should be property restoration and reinstatement of employment for the victims to ensure the restoration of identity, according to the KNCHR.
