The High Court has declined to grant orders by the United Democratic Alliance (UDA) to stay the implementation of a Political Parties Disputes Tribunal (PPDT) decision involving the disputed nomination of Consolata Wakwabubi Nabwire as a replacement for nominated Senator Gloria Orwoba.
Justice Lawrence Mugambi dismissed the application for stay orders and directed the United Democratic Alliance (UDA) to fully comply with the orders issued by the Political Parties Disputes Tribunal.
“Pending hearing and determination of the appeal, the honorable Court be pleased to grant stay of execution of the judgment and order of the honorable Tribunal delivered on 20.08.2025 in PPDT Complaint No. E006 of 2025 – Gloria Orwoba v United Democratic Alliance & Others,” the ruling read.
Court Examines Application for Stay of Execution
In its ruling on 14th April 2026, the High Court considered a motion dated 22 August 2025 seeking to suspend the enforcement of a Political Parties Disputes Tribunal (PPDT) judgment delivered on 20 August 2025 in Complaint No. E006 of 2025.

The applicant, UDA Electoral Nomination and Dispute Resolution Committee, argued that the tribunal’s decision should be stayed pending appeal, warning that enforcement would undermine its disciplinary mandate and expose it to contempt proceedings.
The committee maintained that it had lawfully expelled Orwoba from the party in May 2025 through its internal disciplinary process, and that the tribunal’s decision to overturn the expulsion interfered with its constitutional autonomy.
It further argued that unless a stay was granted, the appeal would be rendered nugatory because Orwoba would continue enjoying party membership and Senate privileges.
The court, however, noted that the applicant must demonstrate substantial loss and legal prejudice beyond internal party dissatisfaction.
It emphasized that the threshold for stay orders is strict and cannot be based solely on apprehension of institutional embarrassment or on the enforcement of disciplinary decisions.
Gloria Orwoba Opposes Application Citing Lack of Prejudice
Senator Gloria Orwoba opposed the application, arguing that the motion was an attempt to delay compliance with a valid tribunal judgment.
She maintained that the PPDT had already forcibly stopped her expulsion due to procedural irregularities and the denial of a fair hearing; therefore, there was no enforceable order that could be stayed in the manner sought.
Orwoba further contended that the applicant had not demonstrated any substantial loss and accused the disciplinary committee of acting in bad faith by proceeding with replacement processes even after the tribunal’s ruling.

Tribunal Findings and Replacement Dispute
The dispute originates from disciplinary proceedings initiated by UDA in May 2025, which led to Orwoba’s expulsion.
Following this, UDA replaced her with Consolata Nabwire through nomination and gazettement processes.
The Political Parties Disputes Tribunal overturned the expulsion, citing procedural irregularities and a lack of a fair hearing, and ordered her reinstatement.
The High Court has now upheld that position by refusing to suspend the tribunal’s decision.
