Lee Muthoga Gachuiga is a prominent Kenyan jurist and Senior Counsel with a legal career spanning over five decades.
Born in 1945 in Nyeri, Central Kenya, he is widely recognized for his contributions to both national and international justice.
Professional Roles and Milestones
International Judiciary- Since 2012, he has served as a Judge of the United Nations International Residual Mechanism for Criminal Tribunals (IRMCT), with his current term set to expire on June 30, 2026.
Before this, he was an ad litem Judge for the UN International Criminal Tribunal for Rwanda (ICTR) from 2003 to 2012.
Muthoga chaired the Law Society of Kenya (LSK) from 1981 to 1983 and was President of the African Bar Association from 1981 to 1987.

He also served as lead counsel in the 1983 Judicial Commission of Inquiry into the conduct of former Attorney General Charles Njonjo and led the team investigating the 2003 Busia air crash.
In late 2024, Muthoga released his autobiography, “Audacity and Sacrifice: My Life and Career,” a memoir that covers his upbringing during the Mau Mau emergency, his father’s detention, his role in Kenya’s transition to multi-party politics, insights into major legal cases, and his advocacy for children’s rights.
In 2003, he was conferred with the rank of Senior Counsel by President Mwai Kibaki.
Early Life and Educational Background
In 1945, he was born under a sacred Mugumo (fig) tree in Munyange village, Nyeri, in Central Kenya, as his mother was returning home from the market when she went into labor, delivering him under the mugumo tree with the help of passers-by, a birth he describes as a prophecy of his future resilience and longevity.
At the age of 12, after witnessing a white man refuse to help his “sick” friend, a prank they made to get a ride, he vowed to become a judge so he could one day sentence such cruel people to death, a resolve fueled by the execution of freedom fighter Dedan Kimathi.
Growing up during the Mau Mau emergency, he was repeatedly suspended or expelled from schools for confronting administrations over racism and unfairness.
His childhood was marked by the nine-year detention of his father, which left his mother to raise the family. Upon finishing his university education, he took on the responsibility of educating his two younger high school-aged siblings before beginning his own career.
As a student, he boldly wrote to Attorney General Charles Njonjo to demand state support for African lawyers entering private practice, challenging the status quo in which established firms were predominantly manned by non-citizens.
Muthoga attended St. Paul’s High School in Embu, and during his Form Four year in 1964, he led a student protest against “unpalatable” school food, famously telling the headmaster, Fr. Lenta, that even the headmaster’s dog wouldn’t eat it. Upon being threatened with expulsion, he brandished a machete to insist on sitting for his final exams.
He earned a Bachelor of Laws (LLB) from the University of East Africa in Dar es Salaam, Tanzania, graduating in 1970, making him one of only 45 law students from the three East African Community states at the time.

While at university in 1969, he mobilized students to write a protest letter to President Jomo Kenyatta following the Kisumu shooting incident involving Jaramogi Oginga Odinga, a bold move that almost derailed his path to becoming an advocate.
Upon returning to Kenya, Lee joined the firm of Hamilton Harrison & Mathews as a pupil and was exempted from the standard pupilage period and admitted as an Advocate of the High Court in 1971, a year earlier than expected.

He was married to Charity Kiama for 42 years until she passed away from cancer in 2019.
Muthoga is the father of four daughters and several grandchildren, and he enjoys spending his time telling them tales and passing on his life lessons.
Now in his 80s, he resides in Nairobi, balancing his remaining term at the UN IRMCT with tending to his tea and avocado farms.
