Safina presidential aspirant Jimi Wanjigi has lost a petition he filed seeking to compel the electoral agency to have his name on the presidential ballot
The High Court sitting in Nairobi on Friday dismissed the petition.
While dismissing the petition, Justice Jairus Ngaah ruled that the case lacked merit.
IEBC failed to clear Wanjigi after he failed to present his degree certificate.
On the clearance day, he had presented his university transcripts.
His lawyer Omwanza Ombati argued that the Commission for University Education (CUE) had cleared him and, therefore, IEBC was bound to accept his university documents.
In its argument IEBC said that transcripts were not equivalent to a degree.
“The key word we want to underline is if the person is a holder of a degree.
“It is our interpretation that a person must have a degree certificate. There must be in existence a physical degree certificate.
“The applicant is not in possession of a degree certificate and never presented it,” IEBC lawyer Moses Kipkogei argued in court.
Wanjigi had accused IEBC chairman Wafula Chebukati of being biased against him
He claimed Chebukati was being used by powerful forces to lock him out of the race
