Four politicians have been given an ultimatum to appear before authorities for grilling. The National Cohesion and Integration Commission (NCIC) has summoned two lawmakers from Tana River County over ongoing investigations on a case of ethnic incitement.
In a statement on Monday, September 30, NCIC directed Galole Constituency Member of Parliament (MP) Said Buya Hiribae and Bangale Ward MCA Jibril Mahamud Farah MCA to appear before the Commission pursuant to Section 27 of NCIC Act.
NCIC is currently investigating a case of Ethnic Contempt, in accordance with section 62(1) of the NCI Act no. 12 of 2008.
In a letter to Hiribae, the Commission stated that it has been alleged he incited residents of Galole Constituency in Tana River County to destroy the Konakaliti Police Station in Kitui South.
The Commission reported that the statements have incited feelings of contempt, hatred, hostility, violence, or discrimination among residents living along the border of Kitui and Tana River Counties.
“Take notice that you are hereby required to appear before the National and Integration Commission at the offices at Britam Towers 18th Floor Upper Hill on Tuesday 8th October 2024 at 2.00 PM so as to assist the Commission with aforementioned ongoing investigations,” NCIC wrote to Hiribae.
The Commission emphasized that the summons must be obeyed as if such summons were issued by the High Court pursuant to Section 29 of the NCI Act.
NCIC stated, “whereas failure to appear in person at the aforementioned place, date, and time, is an offence as provided under Section 63(b) as read with Section 63(c) of the National Cohesion and Integration Act.”
Directives to Mahamud
The Commission said Mahamud is accused of being adversely involved in inciting residents of the Katumba area in Kitui County against the construction of a police station in the region.
NCIC noted that these statements have incited feelings of contempt, hatred, hostility, violence, or discrimination among residents living along the border of Kitui and Tana River Counties.
The MCA is required to appear before the NCIC on Tuesday, October 8, 2024, at 11.00 AM to assist the Commission with the aforementioned ongoing investigations.
Kuno & Former Tana River MP Summoned
NCIC also summoned Bura MP Yakub Dubow Kuno for allegedly being involved in inciting residents of Tana River County to invade Kitui County by forcefully grazing camels and attacking residents in the area.
The Commission has also summoned former Tana River Women Representative Rehema Hassan over similar allegations.

DCI Recommends Charges Against Gachagua’s Allies
This comes after the Directorate of Criminal Investigations (DCI) recommended serious charges against five leaders allied with Deputy President Rigathi Gachagua for their alleged involvement in the anti-finance bill protests.
The directorate has recommended that the Director of Public Prosecutions (DPP) charge Embakasi Central MP Benjamin Gathiru Mwangi, also known as “Mejjadonk,” with soliciting/inciting others to commit an offense as outlined in Section 391 of the Penal Code.
He is also facing conspiracy charges to commit a felony under Section 393 of the Penal Code and money laundering in connection with the Proceeds of Crime and Anti-Money Laundering Act.
Furthermore, the inquiry suggests that Embakasi North MP James Gakuya, George Theuri, Martin Wambugu Ngunjiri, and Pius G. Munene are also implicated alongside Mejjadonk in the conspiracy to commit a felony charge.
The DCI stated that efforts are being made to obtain all financial data from Safaricom, the Financial Reporting Centre (FRC), and the banks where the purported financial transactions were carried out.

NCIC Mandate
NCIC is established by an Act of Parliament, the National Cohesion and Integration Act No. 12 of 2008.
It has the mandate to promote national unity and harmony by promoting peaceful relations among communities, particularly by guarding against negative ethnicity, racism and religious intolerance.
The Commission is composed of both the Commissioners and the Secretariat. NCIC Commissioners include the Chairperson, and six (6) Commissioners appointed by National Assembly.
