The High court of Kenya has freed lawyer-turned-activist and Inclusion of National Justice, Economic, and Civic Transformation (INJECT) party leader Morara Kebaso.
Morara was appearing before the court on Friday October 4, 2024, having been released on a Ksh50,000 cash bail, pending the hearing of his case.
The High Court had earlier during the week directed Morara and his lawyers to appear for a hearing today at 2 pm in which it was to rule on whether he should be admitted to the charges levelled against him by the prosecution.
During the court proceedings, the Director of Public Prosecution (ODPP) had preferred charges against him including cyber harassment contrary to Section 27 of the Computer Misuse and Cybercrime Act.
However, the court has freed the INJECT party leader after the judge found the cyber harassment charges preferred against him as defective.
In a charge sheet presented to the court and seen by The Kenya Times on October 1, the prosecution stated that Kebaso was arrested for allegedly posting false information about businessman David Langat.
The lawyer was later charged with cyber harassment and accused of tarnishing and discrediting the reputation of Langat.

The charge sheet alleged that Kebaso shared false information on his X platform account on September 28, 2024, with the intention of tarnishing Langat’s reputation.

“David Morara Kebaso Alias Morara Kebaso Senior: On the 28th day of September 2024 at an unknown place within the Republic of Kenya, jointly with others not before court, while using the X Corp Account dubbed; MoraraKebasoSnr, knowingly without lawful excuse, posted false information to wit.” read part of the charge sheet.
The information posted by Morara read, “William Ruto approached DL Langat and told him he desperately needs more money for campaign desperately needs more money for campaign. DL Langat used his properties as security and took big loans to help his friend. Right now, DL Langat is being auctioned by banks and the person who is buying the properties is William Ruto. To make it worse William Ruto has used his power to undervalue the properties to buy them at a cheaper price. That is the kind of person we are dealing with. He has no friend.”
Kebaso’s security officer, identified as Geoffrey, shared details regarding the activist’s arrest on Monday, September 30, at his Kahawa Sukari office in Nairobi.

The bodyguard further mentioned that the INJECT party leader was handcuffed and had his phones and laptop taken away before being driven to the Regional Police Headquarters in a Subaru car.
Colleagues and lawyers immediately followed the Subaru to the police station where he was held for questioning.
Kebaso has been actively touring the country to expose stalled government projects and highlight what he sees as widespread corruption.
The activist has become a vocal critic of President William Ruto, claiming that many of his initiatives are either stalled or yet to be launched.
He emphasized the importance of his work in holding the government accountable, stating that he is not concerned about his own safety because it would undermine his efforts.
The father of two had earlier stated that he has received threats and been followed by vehicles with unidentified license plates.
