How Cooperative Societies In Kenya Can Apply For Land Registration

In Kenya, the Ministry of Cooperatives and Micro, Small and Medium Enterprises Development is responsible for overseeing the formation and regulation of cooperative societies, including their capacity to acquire and register land.

For many communities, forming a cooperative is a practical way to pool resources and invest in property.

However, the process of registering land under a cooperative’s name involves several legal and administrative steps.

How to Apply

Step 1: Form and Register the Cooperative

The journey begins with assembling a group of at least ten Kenyan citizens, all above 18 years of age.

These individuals must share a common economic or social goal and possess valid national IDs and KRA PINs.

The group holds a founding meeting to elect interim officials—typically a Chairperson, Secretary, Treasurer, and two committee members.

During this meeting, members agree on the cooperative’s name, objectives, share capital, and entrance fees.

They also draft by-laws that comply with the Co-operative Societies Act (Cap. 490).

Once the name is reserved with the Commissioner for Co-operative Development, the group prepares the necessary documents, including:

  • Application Form (Form I)
  • Signed minutes of the founding meeting
  • Draft by-laws
  • Member list with ID and PIN copies
  • Business or feasibility plan
  • Proof of office address
  • Registration fee (usually between KSh 3,000 and 5,000)

After submitting the application to the County Cooperative Office, the Commissioner reviews it.

If approved, the society receives a Certificate of Registration, officially recognizing it as a legal entity.

Step 2: Conduct Land Search and Survey

With registration complete, the cooperative can proceed with acquiring the land.

The first step is a land search, either through the ArdhiSasa platform or at the County Land Registry.

This search confirms ownership, checks for disputes or encumbrances, and verifies the land’s legal status.

The cooperative then obtains a cadastral map from the Kenya Survey.

If boundaries are unclear or contested, a licensed surveyor may be hired to conduct a physical survey and produce a certified plan.

Step 3: Approve Land Acquisition Internally

Before proceeding with registration, the cooperative must hold an Annual General Meeting (AGM) or a special meeting to pass a resolution authorizing the purchase of the land.

This resolution must be documented in the minutes and signed by the society’s officials. It serves as formal proof that members support the acquisition.

Step 4: Submit Land Registration Application

The cooperative prepares a full application for land registration, which includes:

  • Completed Land Registration Act (LRA) forms
  • Land search results
  • Certificate of Registration
  • Society by-laws
  • AGM resolution minutes
  • Survey plan or cadastral map
  • Copies of IDs and PINs of signatories
  • Proof of payment for stamp duty and registration fees

This application is submitted either physically to the County Land Registry or digitally via ArdhiSasa.

The registrar reviews the documents to ensure compliance with the Land Registration Act (2012) and other relevant regulations.

Step 5: Receive Title and Stay Compliant

Once approved, the registrar enters the cooperative as the legal proprietor in the land register. A Certificate of Title or lease document is then issued in the name of the society.

To maintain compliance, the cooperative must:

  • Hold regular AGMs
  • Submit annual returns and audited financial statements
  • Keep land rates and taxes up to date
  • Seek member approval for any future land transactions
