Attorney General Justin Muturi has revealed that the Public Service Commission (PSC) has been sabotaging his office through appointments.
Appearing before Parliament on Tuesday, February 13, Muturi lamented that PSC had been making appointments of senior government officials in his office without consulting him.

He also complained that bills that involve his office were being taken to parliament without his approval.
As a result, Muturi stated that the office of the attorney general was yet to be operationalized, causing staff at the department to quit.

“It is important for me to delink from the public service Commission. The Office of the Attorney General Act has not been operationalized.
“In a sense, this is what pushed me to look into why staff were exiting in such large numbers. Even when I want to appoint a state council to go and work in some ministry, you hear the PSC saying that that is their work,” he stated.

Muturi Reveals Instances of Sabotage
Giving examples of instances of sabotage, he detailed that the Chief of Staff on the office of the Deputy President Rigathi Gachagua had earlier been appointed to his office as a senior deputy solicitor general.
Additionally, he noted that there was a man who worked at State House but had also been appointed a s a senior deputy solicitor general.
“For instance, a gentleman who works at State House, but he was appointed by the PSC to the level of senior deputy solicitor general.
“The current deputy chief of staff in the office of the deputy president is a senior deputy solicitor general,” added Muturi.
The AG asked that a board is created to ensure that members of the public were served fairly.

‘I am making my case on why it is important for me to delink from the PSC and if this committee could agree with me, give me a board. I am not interested in appointing anybody but a board to serve everybody fairly,” he said.
PSC Earlier Response to the AG
In December 2023, PSC Chairman Anthony Muchiri opposed Muturi’s proposal to amend the law to give him powers to appoint and dismiss officials working in his office.
Speaking while appearing before the Justice and Legal Affairs Committee (JLAC), Muchiri indicated that the move would be unconstitutional.
“The constitutional functions of the Attorney General do not operate in isolation of or independently from the Executive arm of Government.
“Therefore, the office cannot be delinked from the jurisdiction of the Commission and legal framework that regulates the public service and falls within the mandate of the Commission,” he said.
