Company Shut Down Indefinitely After Complaints from Neighbours

The National Environmental Management Authority (NEMA) has closed down Ty Woods K. Ltd, a manufacturing facility located in Kuresoi Sub County, Nakuru County.

In a statement shared on Wednesday, February 5, NEMA stated that the company failed to comply with conditions outlined in an Environmental Restoration Order issued on 6th August 2024. 

Further, NEMA accused the company of failing to comply with a subsequent inspection on 23rd January 2024.

The authority explained that the manufacturing company has been under scrutiny for its environmental practices.

Specifically, NEMA noted that visible fugitive emissions were emanating from leakages in the boiler area and other parts of the facility.

Accusations Against the Company

These emissions, which have caused significant concern among the neighbouring community, were deemed a potential environmental and health hazard.

According to the authority, the company’s operations posed a direct threat to the surrounding environment and the health of the community, as the emissions could have harmful effects on air quality and human health.

These issues were first flagged in August 2024 when NEMA issued the Environmental Restoration Order, instructing the company to take immediate steps to mitigate the impact of the emissions.

However, following a thorough inspection in January 2024, it was determined that the company had not taken enough action to meet the conditions set forth by the order.

Another issue highlighted during the inspection was the company’s failure to obtain an Emissions License, a legal requirement under the Air Quality Regulations 2024.

NEMA officials noted that without this license, the company was unable to demonstrate that it was complying with national air pollution control standards.

Furthermore, Ty Woods K. Ltd had not installed pollution control systems for air pollution, a critical oversight in their operations.

Measures That Must be Met by Ty Woods K. Ltd

Consequently, the authority has ordered the immediate cessation of the company’s operations until adequate measures are implemented to address the environmental concerns.

These measures include the control of emissions to the environment and dispersion modelling.

The company must undertake air dispersion modelling to better understand the impact of their emissions on the surrounding environment and ensure that the effects are minimized.

Also, the company must install an Effluent Treatment Plant (ETP), implement measures to contain oil spillage within the facility and clean-Up of the Facility Compound. 

All streams of waste generated by the facility must also be properly disposed of by a licensed waste handler to ensure compliance with waste management regulations.
