Former Nairobi Governor Mike Sonko on Tuesday, November 5, advised impeached Deputy President Rigathi Gachagua on how he could still appear on the ballot even after his impeachment.
Speaking at the funeral of Lucy Wambui, who passed away following a botched surgery, Sonko outlined legal avenues through which the former Deputy President could pursue a political comeback despite his impeachment.
“Because of bad politics, you were ousted the same way we were removed. Let me teach you a bit about the law: people say that when you are impeached, you cannot vie for any political seat, but that’s a fallacy.
Article 193, sub-article 3, says you shall be on the ballot.You shall be on the ballot. You have to exhaust all avenues of appeal or review. Your case is now in the High Court and is still being heard.
Sonko advises Gachagua on way forward after impeachment
If it is dismissed, you are allowed to appeal to the Court of Appeal—that’s another three years. If the Court of Appeal still dismisses your case, you can go to the Supreme Court, which takes another five years. By 2027, you’ll be there, so you will be on the ballot,” Sonko said.

At the same time, Sonko urged the former Deputy President not to hurry while exhausting legal avenues about his impeachment.
Gachagua, who also attended the funeral, spoke with political undertones about his impeachment, highlighting the aftermath that has followed.

Speaking at the burial, Gachagua said that everything in life has both positive and negative aspects, and his impeachment is no exception.

Gachagua shared that he and his family now have more time to spend with their friends time he did not have while he was the Deputy President.

“Probably, with what has happened to us in leaving office, at least the positive thing is that we have more time for friends. You know everything that happens has a good and a bad side; we have a lot of time for friends, and they are very important,” he said.
Additionally, Gachagua encouraged Kenyans to work hard and remain honest despite the tough economic times.
“Some of us have gotten into a lot of trouble because of being truthful,” he said.
