A woman in Kasarani, Nairobi County, has narrated how she was arrested for reporting a government official who assaulted his son.
Liankey Nyambura said her son was assaulted by a person who visited their neighbour two weeks ago and is believed to be a government official.

She claims that despite reporting the case and submitting hospital documents, there have been delays in prosecuting the suspect who allegedly claims to be a government official.
Nyambura said the incident happened in April, and she has been searching for justice for her 8-year-old son.

She narrated that her son was playing with other children when the visitor assaulted him.
Nyambura said the visitor wanted to let the boy fall from the second floor.

However, he changed his mind and hit him on the ceiling before letting him fall on the ground after noticing that a neighbour was watching.
“The children were playing, and one of the girls went to their house. The father came and grabbed her son into the house.
“He took him to the second floor to let him fall. When he saw the woman, the man hit my son on the ceiling and let him fall on the floor. The child was unconscious for around 15 minutes.”

How Nyambura Was Arrested
Afterwards, Nyambura reported the matter to the Kasarani police station, but she was arrested instead.
“The police ordered that I also be arrested. I asked them if they were arresting me because I refused to pay Ksh10,000 for their ‘tea’ and Ksh10,000 for cash bail, yet it is my son who had been assaulted,” she said.
She was released unconditionally the following day and took her son to a medical facility.
Nyambura was issued with a P3, and the police doctor in his report described the injury as grievous harm.
Besides, she reported the matter at the Kasarani sub-county children’s office.
“So far, we have not received justice; the suspect is free. I am asking for justice for my son and myself for being arrested for no reason,” he said.

Kasarani Police Statement
Kasarani police commander Emmanuel Rono says his officers investigated the case and prepared a charge sheet with grievous harm as the offence.
However, the charge was rejected by the Office of the Director of Public Prosecutions (ODPP) as it was not captured in the witness statements.
The prosecution council rejected the sheet and gave fresh directives to be implemented before the suspect.
“He has been recommended for further investigation. According to his opinion, the statements that were recorded do not meet the threshold of grievous harm. I want to assure the public of Kasarani that there is no cover-up we are making here,” Rono said.
He stated that his officers are working on the gaps raised by the ODPP and that the file, once ready, will be submitted, and the suspect will face the law.
