Meru Governor Kawira Mwangaza is facing another battle suit over ownership of the trademark ‘Baite TV’.
In a demand letter dated November 1, Nextad Media Ltd claimed that it is the legal owner of the name Baite TV.
“Our client is the registered proprietor of the trademark ‘Baite TV’ (Trademark number 11918 from now on, “the trademark”).
As the registered proprietor our client is entitled to all the goodwill, business and profits attaching to or accruing from the commercial use and exploitation of the trademark,” reads the letter in parts.
Further, Nextad noted that Mwangaza has unlawfully and fraudulently passed off as the registered proprietor by commercially exploiting the trademark through a TV by the name ‘Baite TV’.
“Our client has suffered and continues to suffer enormous loss, harm and damage directly attributable to the unlawful and fraudulent passing off and commercial exploitation of the trademark through the TV station mentioned above,” added the letter.

Additionally, Nextad demanded the immediate and unconditional cessation of using the name ‘Baite TV’ in running the TV station associated with Mwangaza.
This comes at a time when governor Mwangaza is facing an impeachment motion tabled at the floor of the senate.
Mwangaza is expected to appear before the Senate to defend herself against the seven charges listed by Meru Members of County Assembly as the grounds for the impeachment motion.
The Senators voted against the motion to form a Special Committee to investigate the charges against Mwangaza.
