Serious Crime Unit detectives from the Director of Criminal Investigations (DCI) on Monday, February 19 arrested a 61-year-ol man who impersonated Winny A. Ochwal, an advocate of the High Court.
In a statement, the DCI said Simon Githu Mbingu was arrested at Muindi Mbingu Street in Nairobi CBD and arraigned at the Milimani Law Courts on Tuesday, February 20.
Githu is accused of pretending to be Winny A. Ochwal Advocates, Commissioner for Oaths.
He was charged with impersonating an advocate contrary to section 33 as read with section 85 (1) of the advocates act.
“On arraignment today, the suspect was released on Ksh.100,000 cash bail, pending the case mentioned at Milimani’s court no. 4 on March 5,” said the DCI.
DCI explained that Mbingu wrote a demand letter for an unsuspecting member of the public who had been defrauded Ksh.20,000.
“You pretended to be an advocate of High Court by writing a demand letter for Joseph who had been defrauded Ksh.20,000 acting as Winny A. Ochwal adbocates, Commissioner for oaths a fact you knew to be false,” read the statement in part.
Date Offence was Committed- DCI
According to the DCI, the suspect committed the offence between 23rd and 25th October 2023 at Muthoni Miruka and Ochola Advocates Commissioner for oaths located at the 8th floor of Kimathi House, Nairobi County.
“Upon search in his Kimathi House office, a stamp reading Winny A. Ochwal Advocates was recovered before he was arrested and booked at Muthaiga Police Station,” added the DCI.

Man Impersonates Justice Ouko
On December 15, 2023, one Oduor Leakey Amolloh was presented at the Kiambu Law Courts on allegations of impersonating Supreme Court Judge Justice William Ouko.
In a statement, the Judiciary said Amolloh obtained money from unsuspecting members of the public by false pretense.
“Amolloh was arrested on December 8, 2023, in Migori County and presented before the Court on December 11, 2023, under Miscellaneous Criminal Application No E472/2023.
The Directorate of Criminal Investigations (DCI) asked for, and the court granted them three days to complete their investigation hence his appearance today,” read the statement.

According to court papers, on November 24, 2023, Justice Ouko received information that a mobile number 0728 494 058 purporting to be his mobile number was being used to defraud members of the public in pretext that he could influence public employments.
Using Justice Ouko’s name he also solicited and received money from unsuspecting victims.
Justice Ouko made a report to the police and upon recording a statement, investigations commenced.
DCI investigators also received intelligence from the local police and residents of Awendo area that there are complaints from members of the public against the respondent.
