The county government of Machakos has issued a warning to the public concerning the sale of part of the controversial Mavoko land in Athi River.
In a notice on Wednesday, November 1, the county government led by Governor Wavinya Ndeti, indicated that the sale of the land was illegal, and buyers will only purchase the land at their own risk.
Further, the notice indicated that Portland Cement company did not follow the laid-out procedure by the law for regularization of land.
Moreover, the pieces of land in question included L.R. NOS. 7815/1, 8784/4, 8786, 10424, 10425, 8784/1,8784/2,8784/3, 8785,8784/144, 878 8784/145, 8784/653.
“It has come to the attention of Machakos county Government that various individuals and entities, including among others the proprietors of the parcels mentioned above,
“Are attempting to regularize ownership of the lands to individuals and entities without following the requisite due process as laid down in the laws of Kenya,” the notice read in part.
Reasons Why it is Illegal to Sell the Mavoko Land
Giving reason for the warning, the county government indicated that the proprietors had not received consent to sell or subdivide it.
Additionally, there had been no application to change the use of land from agricultural or residential for human settlement.
Secondly, the notice indicated that the parcels of land were not surveyed, unserviced, and unregistered.
Members of the public were also warned against buying the land because “the proprietors had not notified the public of any intention to plan the properties as required under the Physical and Land Use planning Act 2019.”

At the same time, Governor Ndeti indicated that the county government had not received any application for development for consideration or approval.
“The proprietors and the said entities have not involved any Multi Sectoral team involving all stakeholders, National and County Government, the National Land Commission and social leadership in any planned regularization.
“The proprietors and said entities have not set aside any suitable and adequate land to be surrendered by the applicant at no cost to the County Government for open spaces, amenities, recreational facilities, road reserves, public purposes relating to the area to been subdivided/regularised or for road-widening,” added the notice.
Way Forward for Interest Buyers
For those who had interest in purchasing the land, the county government advised them against it until due process was followed by the proprietors.
On the other hand, the notice stated that the subdivision or allotment or regularization of any land without the approval of the county government is unlawful and illegal.
“The Machakos County Government advises members of the public not to make investments on unplanned, unsurveyed, un serviced and unregistered land until the due legal process is followed.
“Take further notice that any person(s) purchasing and or regularizing any of the
Properties shall do so at their own risk,” added the notice.

Sale of Mavoko Land
Earlier in a notice on Tuesday, October 17, the Portland Cement company announced the sale of some of the pieces of land indicating that it would give priority to individuals who were already occupying the said pieces of land.
Additionally, the notice stated that those who were being evicted ought to state their claim on the land within the following 14 days otherwise they would be offered the general public.
“East African Portland Cement wishes to notify members of the public of its offer to sell the above referenced parcels of land (REGULARIZATION OF LR NO. 8784/144, 145 & 653 MAVOKO) via a regularization model,” the notice read in part.
