Court Gives Way Forward on Prime Suspect in Kware Serial Murder Case

Ndegwa has argued that the evidence presented by the police is more than sufficient to proceed to trial.

Collins Jumaisi Khalusha, the key suspect in the killings and dumping of bodies at Kware dumpsite in Mukuru Slums, Nairobi will be detained pending further investigations into the case.

Principal Magistrate Irene Gichobi on Tuesday, July 16, allowed the Directorate of Criminal Investigations (DCI) to detain the serial murder suspect at any police station for 30 days to allow police to complete investigations.

Earlier, John Maina Ndegwa, the lawyer representing the suspect accused of killing 42 women since 2022 and dumping bodies at the Kware dumpsite had opposed his detention.

The lawyer, while speaking outside Kiambu Law Courts, opposed the Director of Public Prosecution’s (DPP) request for more time to complete the investigation.

Ndegwa further demanded transparency for the Kenyan public while fiercely criticizing the ongoing legal proceedings, calling them a ‘sham’.

This came after the court ordered the case to be moved to the Makadara Law Courts from the Kiambu Law Courts where the suspect had appeared to face charges.

According to the lawyer, the government has filed a miscellaneous application seeking to detain the suspect for an additional 14 days to conclude their investigations.

Ndegwa, however, argued that the evidence presented by the police on Monday, July 15, is more than sufficient to proceed to trial.

“At this juncture it is best to give him a chance let the due process of the Law take place. Yesterday we were treated to some circus and today as we come to court, we expect that whatever evidence was paraded will be produced in court.

We expect that whatever the prosecutor produced as evidence we wouldn’t expect them to seek for more days to look for evidence what was paraded yesterday is enough to proceed with the trial so I would be much baffled when the investigating officer or the DPP goes to court to seek for more days for investigation,” said the lawyer.

The lawyer while launching an attack on the government further questioned the need for more time when significant evidence had already been displayed by the Directorate of Criminal Investigations (DCI) chief, Mohamed Amin and acting Inspector General (IG), Douglas Kanja.

At the same time, the lawyer when asked to comment on the claims that his client, Khalusha confessed to killing 42 women, including his wife, declined to comment revealing he is yet to see the confession.

“The manner and the circumstance in which he gave the confession we cannot comment on right now. We are yet to see it,” he said.

DCI Issues Statement After Suspect is Arrested

Khalusha who is believed to be the mastermind behind the macabre killings and body dumps at Kware dumpsite in Embakasi, Nairobi was presented before court after he was apprehended by police in a dramatic nocturnal sting operation.

DCI boss Amin in a press statement on July 15 said that by 8am yesterday, the suspect had reportedly confessed to the murders, admitting to killing 42 women between 2022 and July 11, 2024.

Amin further detailed how the suspect was tracked using a mobile signal from a phone of one of the victims Josephine Mulongo Owino.

He said that the transaction of mobile money transfer using the victim’s phone number led detectives to the suspect.

The DCI chief also revealed that according to Khalusha’s confession, his first victim was allegedly his wife, Imelda, whom he killed in 2022 after a business venture failed.

“He told us that he killed his wife out of bitterness. That he chopped her and dumped her at Kware, but all these statements are subject to investigations. He is a person full of vengeance and hatred,” Amin stated.
