A man has been sentenced to death for the offense of robbery with violence by Tamu Law Courts Senior Principal Magistrate Hon. Amos Mokoross.
Kevin Onyango Kiyogo was charged with two counts, robbery with violence, contrary to section 296(2) of the Penal Code, and stupefying in order to commit a felony, contrary to section 230 of the Penal Code.
It was alleged that on June 23, 2023, in the Kogutu area of Muhoroni Sub- County, Kisumu County, Kiyogo, armed with dangerous weapons, used actual violence to rob James Kamau of his Toyota Hilux, valued at Ksh1,800,000.
“On the first count, the accused Kevin Onyango Kiyogo while armed with dangerous weapons using actual violence robbed James Kamau of his motor vehicle Toyota Hillux valued at Ksh 1, 800,000,” read a statement from the Office of the Director of Public Prosecutions.
“While on the other hand, he was charged with administering an overpowering drug to James Kamau.”
He was also charged with administering an overpowering drug to Kamau.
The prosecution, led by Ms. Beatrice Langat presented evidence through testimonies from eight witnesses.
Death Sentence for Robbery
The court found the evidence and exhibits compelling, concluding that Kiyogo, along with others not before the court, committed the offenses against Kamau.
In his judgment, Magistrate Mokoross sentenced Kiyogo to death for the robbery with violence charge.

For the second count of administering an overpowering drug, Kiyogo was sentenced to five years imprisonment.
The death sentence will be held in abeyance until the completion of the five-year prison term.
The death sentence, according to a statement from the Office of the Director of Public Prosecutions (ODPP) will be held in abeyance until the completion of the five-year sentence.
