The Nairobi County Government has announced a six-month amnesty under the Nairobi City County Regulation of Unauthorized Developments Regulations.
In a notice on December 5, Nairobi County is allowing developers, property owners, and occupiers to regularize unauthorized developments without penalties.
“The Nairobi City County Regulation of Unauthorized Developments Regulations, 2025 offer a one-time opportunity for developers, property owners, and occupiers to bring unauthorized developments into compliance, without penalties,” read part of the notice.
“All developers are hereby required to ensure full compliance with the stipulated Statutory and planning requirements within six (6) months from the date of Issuance of this notice. Failure comply within the specify specified timeframe shall attract appropriate enforcement measures in accordance with applicable laws and regulations.”
The waiver provides a legal and safe way to bring both completed and ongoing developments into compliance.
Developers or landowners will receive formal recognition, compliance certification, and integration into County plans and infrastructure, with guidance from County professionals.
Nairobi County Opens Six-Month Waiver Window for Nairobi Developers
Applications can be submitted online via the Nairobi Planning and Development Management System (NPDMS) or in person at designated County offices.
Property owners may submit existing documents, and the County Planning Department will guide them on any additional requirements.
Conditional approvals may be granted with clear steps to full compliance, after which a Certificate of Compliance will be issued.

Developments to Be Regularized
Eligible developments for regularization include changes or extensions to subdivisions or amalgamations, building plans, occupation, and the renewal or extension of permits.
Developments that cannot be regularized include those on public land, riparian zones, or protected areas.
In addition, unsafe structures, developments violating court orders, or those undertaken after October 2025.
All applications must be certified by registered professionals, including planners, architects, or engineers, who will be held accountable for false or negligent submissions.
Payments for the process will be made in accordance with the Nairobi City County Finance Act.

Why You Should Apply
According to the notice, applying during the amnesty allows property developers to avoid enforcement actions or penalties.
After applications are submitted, the developer’s property will be integrated into the County’s plans and infrastructure.
They will also receive guidance from County professionals, and no penalties will be applied for coming forward during the amnesty period.
Sakaja Warns of Illegal Developers
In October, Nairobi Governor Johnson Sakaja called on property owners with illegal or unapproved structures to take advantage of the limited amnesty offered under the new property regularization law.
Under the Regularization of Unauthorized Developments Act, Sakaja warned that owners of non-compliant buildings must bring them into order during the grace period, after which strict enforcement measures will be applied.
“If you have an unauthorised building, this is your chance to regularize it. Once the amnesty period ends, the law will take its course,” Sakaja said.
He further stated that after the deadline, the Nairobi City County Government will launch a citywide operation targeting unauthorized structures that fail to meet planning and safety standards.
