Kibwezi West Member of Parliament (MP) Mwengi Mutuse has explained why he has been avoiding public appearances since after sponsoring Rigathi Gachagua’s impeachment motion.
Speaking in Tharaka Constituency, Mutuse said he didn’t want to speak about the impeachment motion in public gatherings after it was successfully supported by the majority of the MPs and Senators.

Mutuse stated that he didn’t want people to think that the impeachment was targeting an individual
“Since we finished this work at the National Assembly and at the Senate, I have not been attending public gatherings because I didn’t want to talk about these issues to make it look like it was instigated,” he said.

The MP asked the residents to advise Gachagua to allow wisdom to prevail while avoiding delving deeply into the matter.
“Therefore, if I don’t speak about it here you will understand me. Even strength must give way to wisdom. So, when you see that person, tell him he must give way to wisdom no matter how strong he is,” he added.

Mutuse Defends MPs and Senate Decision
He argued that Kenya is a democracy founded on a Constitutional order that was bestowed on Kenyans in 2010.
Mutuse said 282 MPs and 53 Senators voted to impeach Gachagua adding that numbers matter in a democracy.
“In a democracy, numbers matter and have meaning. 282 MPs against 44 said Kenya must change, in the Senate, 53 Senators against 13 said the same,” Mutuse said.

Gachagua Impeachment Case
Gachagua’s impeachment found its way to the courts after going through the National Assembly and the Senate.
Chief Justice (CJ) Martha Koome formed a three-judge bench consisting of Justices Eric Ogola, Anthony Mrima, and Freda Mugambi to preside over Gachagua’s case.
In the latest twist in the case, the bench refused to recuse itself from the proceedings.

Justice Eric Ogola ruled that the applicant’s request for the judges to recuse themselves has been disallowed.
However, the petitioners were granted leave to file and serve an amended petition, if need be, within five days of this order.
“Parties are at liberty to file and serve any responses and all further responses to either of the applications together with skeleton submissions within two days of this court. Leave for appeal is hereby granted,” Ogola ruled.
The bench will hear these said applications on Tuesday, October 29, at 10:00am at Milimani Law courts.
