Environment Cabinet Secretary Aden Duale has hit back at Tana River Senator Danson Mungatana for filing a censure motion against Deputy President Rigathi Gachagua.
Duale has schooled the Senator on how to file an impeachment motion, explaining that Senate cannot initiate such a motion.
“A motion for impeachment of the Deputy president can only originate in the National Assembly pursuant to Article 150 of the Constitution.
“The motion must be supported by one third which 117 Members and then supported by 233 Members of the National Assembly for it to pass.”
The Senator has filed a censure motion against the DP over what he has termed as conduct unbecoming.
This follows reports of an alleged impeachment motion that is set to be tabled against the Deputy President.
Mungatana has stated that he is concerned about Gachagua’s utterances about employment opportunities to Kenyans in the public service.
Additionally, he has argued that the DP on several occasions has incited Kenyans to disobey directives by some county governments.
“Rigathi Gachagua, E.G.H. on several occasions since his assumption to the Office of Deputy President, has made utterances, among others, regarding employment opportunities to Kenyans in the public service;
“Allocation of resources to the devolved units; and incitement of a section of Kenyans to disobey lawful directives by some county governments,” the filed motion reads in part.

Other Arguments Made by Senator Mungatana
Additionally, the senator stated that the statements made by Gachagua have marginalized Kenyans.
Consequently, he has explained that the statements have created and continue to heighten tension among different ethnic communities in Kenya.
“Portrays the conduct of Rigathi Gachagua as being in contravention of the provisions of Article 75 of the Constitution.
“Are against the national values and principles of governance espoused in Article 10(2) of the Constitution; and demean the high office of the Deputy President of the Republic.”

What is a Censure Motion
A censure motion expresses disapproval or condemnation of specific actions or policies, which can apply to the government or an individual minister.
The power to censure and its consequence is not directly stated in the Constitution of Kenya.
Therefore, even if Gachagua is censured, the President is under no obligation to fire him or her.
In most cases, censure serves as an official record of disapproval but does not carry the same weight as a no-confidence motion.
A censured politician can still remain in office despite the rebuke.
