The importance of obtaining a National Environment Management Authority (NEMA) license for waste transporters in Kenya was underscored in a ruling by the Environment and Land Court in Nairobi.
The court’s decision, as highlighted in Petition 3 of 2021 on August 3, 2022, emphasized that waste transporters must be licensed by NEMA, as mandated by the Environmental Management & Coordination Act 1999 and EMCA Waste Management Regulations 2006.
In the ruling, the court clarified that despite some waste transporters arguing that their licenses from County Governments were sufficient, the NEMA license is a mandatory requirement.
“The Authority has noted that some waste transporters argue that since they had been licensed by the County Governments, they do not need the NEMA license. This is illegal!” said NEMA in a statement.
Repercussions of Operating Without a Valid NEMA License
Furthermore, this legal standpoint aims to ensure compliance with environmental regulations and standards, ultimately contributing to proper waste management practices in the country.

The Authority noted that waste transporters operating without a valid NEMA license risk facing arrest and prosecution.
“The Authority wishes to notify waste transporters that they risk arrest and prosecution for operating without a valid waste transportation license issued by NEMA,” read the statement.
This directive serves to uphold environmental laws and regulations, promoting responsible waste transportation practices that safeguard public health and the environment.
Consequently, the decision serves as a significant reminder to waste transporters across Kenya, emphasizing the necessity of adhering to legal requirements set forth by NEMA.
By obtaining the proper licensing, waste transporters not only ensure compliance with the law but also contribute to sustainable waste management practices that benefit society as a whole.
Call to Action for Waste Transporters
In light of this ruling, waste transporters are urged to prioritize obtaining the required NEMA license to avoid legal repercussions and to align with environmental conservation efforts.
NEMA’s stance on this matter reflects a commitment to enforcing regulations that protect the environment and promote responsible waste management practices in Kenya.
